# Additional agreements

In Immodio's rental agreement generator, you have the option to include additional agreements in the rental agreement. You can either insert pre-formulated, legally verified **"Other agreements"** by ticking a box or freely formulate **"Individual agreements"**.

#### Other agreements

By ticking a box, you can include other agreements that have been checked by a lawyer in the rental agreement. The following other agreements are currently available to you:

<summary><strong>1) Prohibition of drilling in tiles</strong></summary>

This clause prohibits the tenant from drilling in tiles and joints, for example to attach towel rails or mirror cabinets. For the ban to be effective, the bathroom should already be equipped with all the necessary furnishings. If such basic equipment is missing, the tenant cannot simply be prohibited from attaching it. Immodio recommends providing the following elements:

* Towel rail at the sink (and shower or bathtub)
* Toilet paper holder
* Mirror cabinet or mirror with shelf and light
* If no splash guard is available: shower curtain rod

**Important:** Document this equipment as items in the unit in Immodio. In this way, the equipment is also included in the handover protocol. This is the only way you can claim damages from the tenant in the event of damage to tiles.

<details>

<summary><strong>2) The new tenant takes over items from the previous tenant</strong></summary>

Choose this addendum if the new tenant takes over furnishings or structural changes from the previous tenant (e.g. floor coverings, wallpaper, furniture or a kitchen). This makes it clear that they are not part of the leased property and therefore there is no obligation on the part of the landlord to maintain or repair them.\
This additional agreement also ensures that the tenant is obliged to completely remove the items taken over when he moves out.

<summary><strong>3) Loan of a fitted kitchen</strong></summary>

If you select this clause, it will be agreed with the tenant that the fitted kitchen will be made available on loan in accordance with Section 598 of the German Civil Code. This means that the kitchen is provided for use free of charge and outside the actual rental property. In this case, the landlord is not obliged to maintain the kitchen or to replace it in the event of defects.

* However, it has not been conclusively clarified from a legal point of view whether this regulation is effective in every individual case, especially if the kitchen is a significant part of the apartment or was advertised as an essential feature of the equipment at the time the contract was concluded.

In this case, no rent surcharge may be charged for the kitchen, because a loan is **always free of charge**. Make sure that the **agreed rent would be in line with the market** even without a kitchen. If you calculate the rent on the basis of a rent index, you must not calculate a surcharge for a fitted kitchen.

#### Individual agreements

In the Immodio rental agreement generator, you have the option of including individually negotiated agreements with the tenant in the rental agreement. These agreements may be freely formulated by you to address specific needs or circumstances.

It is important that these individual agreements do not conflict with the standard clauses of the Immodio rental agreement and do not violate any legal provisions.

In individual cases, we recommend that such agreements be reviewed by a lawyer in order to avoid legal uncertainties and to ensure the effectiveness of the rental agreement and the individual agreements.

**Note:** Please note that individual agreements may affect the validity of the rental agreement or individual agreements. In this case, the legal conformity of the rental agreement reviewed by a lawyer can be impaired.
