# Energy certificate

According to **§ 80 of the Building Energy Act (GEG)**, landlords are obliged to present or display a valid **energy certificate** at the latest when viewing the apartment. Either as a **demand** or **consumption certificate**.

This obligation applies in principle to all buildings that are heated or cooled.

**There is no obligation to provide identification, e.g. for:**

* Unheated storage or garage areas
* Buildings with less than 50 m² of usable space
* Listed properties
* Holiday properties with use under 4 months/Jahr
* Demolition buildings

**The following information is also required in the rental notification:**

* Type of energy performance certificate (demand or consumption certificate)
* Value of final energy demand or consumption according to energy performance certificate
* The main energy sources for the heating of the building mentioned in the energy certificate
* Year of construction of the building according to the energy certificate
* The energy efficiency class according to the energy certificate

**Attention:** As a rule, the creation of a consumption certificate is sufficient. In some cases, however, you are obliged to create a requirement certificate ("Obligation to issue a requirement certificate"). A missing or incorrect energy performance certificate can be punished as an administrative offence with a fine. The demand certificate is based on a technical analysis of the building. It evaluates energy requirements based on factors such as insulation, window quality, heating system and construction, regardless of actual user behaviour.

**Pros:**

* Significantly more expensive than a consumption certificate

<summary><strong>Mandatory issuance of a demand certificate</strong></summary>

In principle, landlords (owners) have the choice of whether they want to have a demand or consumption certificate issued for their property. Due to the lower costs, the creation of a consumption certificate is more in the interest of the landlord. However, the requirement certificate is mandatory in the following cases:

* For new buildings, as no consumption data for the last three years are available. (The same applies after the implementation of certain modernisation measures on the building, for which an energy certificate must be issued on the basis of § 80.2 GEG.)
* For buildings with fewer than 5 residential units whose building application was submitted before 1 November 1977 (before the entry into force of the 1977 Thermal Insulation Ordinance) and without renovation in accordance with the Thermal Insulation Ordinance.
