# House rules

#### General information on the house rules

The house rules serve to ensure orderly and trouble-free coexistence in the house. It specifies the obligations that the tenant has already assumed in the lease agreement – in particular with regard to the use of the leased property and behaviour in the communal living environment. As a rule, the house rules become part of the rental agreement as an appendix. **Only then is it legally binding.** If it is only posted in the hallway, it has **no contractual effect**. This is only the case if it is **part of the rental agreement**. **Immodio therefore always advises attaching house rules to the rental agreement.**

**House rules already in place**

If house rules already exist in your home, Immodio recommends that you continue to use them. New house rules or changes to the existing version may require the **consent of all existing tenants concerned**. This field is filled in by default if the property in the tab House rules a house rule is already stored as a PDF file.

**No house rules available**

If there are no valid house rules for your property – which is often the case, especially for new buildings or first rentals after renovations – Immodio offers you the service of creating individual house rules. This field is hidden by default if the property in the tab House rules a house rule is already stored as a PDF file.

**House rules for condominium unit**

**Special feature of condominium owners' associations (WEG):** In these cases, there are usually already valid house rules. It is part of the **Declaration of Partition or Community Rules** and is therefore binding. If you are unsure, please contact your **WEG administration**. Load these in the property in the House Rules tab as a PDF file to automatically transmit them to your tenant.

Immodio offers you the service of having house rules individually created for your property. Individual regulations on the following topics can be included:

* **Barbecue with charcoal** is allowed
* **Grilling with gas** is allowed
* **Underground parking** is available and is co-rented

The house rules are then generated by Immodio, transferred to your tenant together with the other generated documents and stored directly in the property. Thus, it can be assigned to all future tenancies.

<summary><strong>Existing house rules</strong></summary>

You have the option of uploading an existing house rule as a PDF file. After uploading, the house rules are automatically stored in the master data of the respective property.

As soon as the house rules are stored there, they are automatically adopted when creating future tenancies and displayed in the rental agreement.

<summary><strong>Do not add house rules</strong></summary>

As a rule, the house rules are attached to the rental agreement as an appendix. Only in this case is it fully legally binding for the tenant. If the house rules are only posted in the stairwell, they have **no contractual effect**. In this case, only regulatory provisions (e.g. rules of use or night-time rest regulations) become legally effective, but no further obligations for the tenant. **Immodio therefore recommends that you always attach the house rules to the rental agreement** in order to create a clear contractual basis.

In most properties, valid house rules are already in place. If your unit is part of a condominium owners' association (WEG), the currently valid house rules of the WEG must be used. If you have any questions or ambiguities, you should contact your responsible property management company.

<summary><strong>Violation of the house rules</strong></summary>

If a tenant violates the valid house rules, the landlord can insist on compliance. In the case of repeated or serious breaches of duty, this can even justify termination of the tenancy. You can find suitable templates on the subject of warnings and dismissals in Immodio under "Templates".

<summary><strong>Amendment of the house rules</strong></summary>

The landlord cannot make changes to the house rules unilaterally. Such changes are only effective if they are contractually agreed with the tenant – for example, by signing or integrating them into the rental agreement.
