Basic information on renting out living space
In the case of residential rentals, it is assumed that the tenant as an economically weaker contractual partner is opposed to an economically stronger landlord who is the owner of the apartment. Since the tenant fulfils a basic existential need by renting an apartment, there is a special need for protection vis-à-vis the landlord.
In contrast, the landlord is usually not assumed to be existentially dependent on the rental, unless the rental income from the rental of housing is his only source of income.
