**Basic information on renting out living space**

* In the case of **residential rentals**, it is assumed that the tenant as an economically weaker contractual partner is opposed to an economically stronger landlord who is the owner of the apartment. Since the tenant fulfils a basic existential need by renting an apartment, there is a special need for protection vis-à-vis the landlord.
* In contrast, the landlord is usually not assumed to be existentially dependent on the rental, unless the rental income from the rental of housing is his only source of income.
