According to § 556b BGB, the rent is payable monthly in advance, no later than by the 3rd working day of a month. The decisive factor is the receipt of payment in the landlord's account.
In the Immodio tenancy agreement generator, you can also individually specify when the rent is due – e.g., on the 1st working day of a month or at a later date. The agreed arrangement is automatically included in the tenancy agreement. After this period, the tenant automatically falls into default in case of non-payment.
Reminder fees
In Immodio, a flat reminder fee of €2.50 is suggested by default. This applies if the tenant falls behind on rent payments. You can adjust this value individually in the "Reminder Fees" field or choose not to charge any reminder fees.
The reference value of €2.50 is based on an older judgment of the AG Brandenburg an der Havel (judgment of 25.01.2007 – 31 C 190/06). At that time, the court considered this amount to be just still reasonable, since only minimal actual costs are incurred when a reminder letter is generated automatically. However, this case law is not of the highest court. In addition, it can be argued in individual cases that due to inflation Increases in costs may be taken into account when assessing appropriateness.
However, it is crucial that reminder fees may only ever cover the costs actually incurred. Immodio recommends not to exceed the proposed amount of €2.50, unless a verifiably higher effort can be proven.
A flat-rate agreement of reminder fees is only permissible if it is not unreasonably high and the tenant has the opportunity to prove a lower damage. Therefore, the Immodio tenancy agreement automatically contains the legally required notice according to § 309 No. 5 BGB that the tenant is explicitly allowed to prove that the flat-rate reminder fees are unreasonable.
Bank details
Immodio automatically takes over the bank details from those listed under Parties stored master data of the owner. If needed, you can adjust the information individually at any time.
If the account holder differs from the name of the landlord, please enter it manually.
