# Changes (tenancy agreement)

In the **"Changes"** tab, you can enter **adjustments to a tenancy**.

* The changes are also visible to your tenants in the tenant portal in the respective tenancy.
* In the case of adjustments to the net cold rent and the operating costs, only the current values and the last two changes are visible to your tenants.

The adjustments are only used to document and manage your tenancies in Immodio. They must inform the tenant independently about adjustments and comply with the legal regulations.

#### Record Termination

You can document that a tenancy has been terminated by clicking on **"Record termination"**.

1. Select who gave notice of termination:

* **Landlord** – if the termination is given by the landlord
* **Tenant** – if the tenant terminates the tenancy

2. Then enter the **Cancellation Date**.

* If a **minimum rental period** is specified in the rental agreement, the agreed date will be displayed here. In principle, an ordinary termination can only take effect **after the minimum rental period has expired**. The date displayed serves as a guide for the earliest possible termination of the tenancy.

3. Click on **"Save"** to document the cancellation in the system. The termination is then saved in the tenancy and the status is updated accordingly. The status changes to "Terminated" if the cancellation date is in the future and automatically becomes "Terminated" if the cancellation date is in the past.

The marking of a tenancy as "terminated" in Immodio serves exclusively for internal documentation and has no legal effect. An effective termination must be made in writing in accordance with § 568 BGB. Corresponding termination templates for landlords can be found in the "Templates“.

#### Adjust net cold rent

You can document a change in the monthly net cold rent via **"Adjust net cold rent"**. This may be necessary, for example, in the event of a rent increase, a rent reduction or an adjustment after modernization measures. The adjustment is saved with an **effective date** and documented in the rent development under "Details" of the tenancy in a comprehensible way for you.

1. Enter the future monthly rent amount in the **"New net cold rent"** field.

* Below the input field you will also see the **currently valid net cold rent** so that you can understand the change.

2. Then indicate **from which date** the new net cold rent should apply.
3. Click "Save" to document the adjustment. The adjustment is stored with an **effective date** and documented in the rental development under "Details" of the tenancy in a way that is comprehensible to you.

**Information on comparative rent**

If a rent increase has been agreed according to **comparative rent**, Immodio will display appropriate notices if the planned adjustment may violate **statutory rent restrictions** (for this purpose, any existing rent regulation must be specified in the basic data of the property).

* **Earliest possible date of a rent increase:** A **rent increase** according to § 558 para. 1 BGB is permissible at the earliest 15 months after the last rent increase – Immodio automatically calculates this time for you and displays a notice if the selected date is too early.
* **Capping Limit:** Immodio automatically checks the **Capping Limit**, which stipulates that the rent may increase by a maximum of 15% or 20% within three years (depending on the master data of the property); if this limit is exceeded, a corresponding notice appears (for this purpose, any existing rent regulation must be published in the basic data of the property).

#### Adjust operating costs

You can use **"Adjust operating costs"** to document changes to the monthly operating cost prepayments or the operating cost lump sum.

1. In the **"New operating costs"** field, enter the future monthly amount of the operating costs (advance payment or lump sum).

* Below the input field you can also see the **currently valid operating costs** so that you can understand the change.

2. Then indicate **from which date** the new operating costs should apply.
3. Click "Save" to document the adjustment. The change is saved with the specified effective date and clearly stored in the cost development under "Details" of the tenancy.

The adjustment of the operating costs is used exclusively for documentation in Immodio and is required for the use of the function Operating Cost Statement relevant. #### Adjust more people who have been drafted

You can use **"Adjust additional conscripts"** to document when additional persons move into or move out of the apartment.

Typical examples are:

* Partner moves in or out
* Family addition

This information serves to document the actual use of the apartment. This may be particularly relevant if the **operating cost statement** **an allocation key according to the number of persons** is used *(this is not yet possible in Immodio)*.

#### Adjust the purpose

You can use **"Adjust Purpose"** to document a change in the purpose of payment for the rent payment. The **Reference** is relevant for an **automatic allocation of rent payment** in the context of the rent receipt control in Immodio *(this function is currently still being expanded).*

* In the field **"Old purpose"** you can see the currently stored purpose. This serves as a guide and cannot be changed.

1. In the **"New Purpose"** field, enter the future purpose of the unit.
2. Click "Save" to document the adjustment. The new purpose of use is then deposited in the tenancy.
