# Documents (tenancy agreement)
### Documents (tenancy)
In the **"Documents"** tab, you can see all documents and documents that are assigned to the respective tenancy.
All documents in the "**Automatically generated**" folder in the tenancy are automatically made available to your tenant in the tenant portal, provided that they have access (you can find more information about the invitation to the tenant portal here).
The documents in the "Other documents" folder are **not** shared with your tenant. This folder serves your internal administration for all documents relating to the tenancy.

#### **Overview of automatically generated documents in the context of the creation of the lease agreement**
When creating a new tenancy, the following documents are transferred to the tenancy. Make sure that your tenant has access to the tenant portal so that they can view it independently. Alternatively, you can download all documents and download them, e.g. via e-mail to your tenant.
**1. Rental agreement (draft)**
Once you have created the draft contract, it will be made available to your tenant. The tenant can view the rental agreement and then sign it digitally. The contract must be signed by all tenants. It is sufficient if one of the tenants is linked to a tenant portal, as all tenants can sign via an account.
**2. Rental agreement**
After signing by all tenants and you as the landlord / broker /Verwalter all parties receive the final version of the rental agreement including all signatures transferred to the tenancy.
**3. House rules (optional)**
If house rules have been stored in the property or added accordingly in the rental agreement assistant, they will be automatically transferred to the tenant. It is therefore binding and part of the rental agreement. If there is no digital provision, point the tenant to the corresponding notices in the property.
**4. Landlord's confirmation**
This is generated for you as a landlord immediately after you have signed, but is only automatically made available to the tenant in the tenant portal **at the beginning of the lease**. As a landlord, you are legally obliged to provide the tenant with a landlord's confirmation after moving in. The tenant needs the landlord's confirmation to register his residence with the registration office, which is legally mandatory according to ยง 17 of the Federal Registration Act (BMG).
**5. Privacy Policy**
Immodio supports you in fulfilling your legal information obligations and automatically provides the tenant with a personalized data protection instruction in the tenant portal when signing the rental agreement. This contains your details as the data controller, your contact details and information on the processing of the data in the existing tenancy and ensures that the tenant receives the legally required information in accordance with Art. 13 GDPR.

As a landlord, you remain responsible for properly processing personal data and for correctly informing your tenants about the data processing. Therefore, please check on your own responsibility whether the data protection information provided is sufficient for your specific application or whether an individual adjustment is necessary.

**6. Brochure "Proper heating and ventilation"**
This brochure is automatically created for your tenant by Immodio and is part of the rental agreement. It informs the tenant about correct ventilation behaviour and contributes to mould prevention.
**7. Cancellation Policy**
Immodio automatically provides the tenant with a cancellation policy in the tenant portal after signing the contract. As a landlord, you are responsible for checking whether it has been created and transferred correctly.

**Important:** If the tenant has not been instructed or has not been instructed correctly, the revocation period does not begin until receipt of the proper instruction and ends no later than 12 months and 14 days after conclusion of the contract in accordance with Section 356 (3) sentence 2 of the German Civil Code (BGB). In this case, the tenant could live in the apartment free of charge for over a year.

**8. WG Regulations (optional)**
When creating a shared apartment rental agreement, you can store a shared apartment agreement in the wizard. If this has been added accordingly in the Rental Agreement Assistant, it is automatically transferred to the tenant in the tenant portal. It is therefore binding and part of the rental agreement.

#### Handover protocols
Under "Handover Protocols" you can:
* create a digital handover protocol or
* Upload an existing protocol.
If you create a new digital **handover protocol** directly from the tenancy, it will be automatically transferred to the tenant in the tenant portal after all parties have signed.
In the handover protocol, you document the condition of the apartment, the meter readings and any defects. An existing handover protocol is part of the rental agreement.
