Data protection for tenants
The protection of personal data plays an important role in the real estate industry, especially when dealing with sensitive tenant data. Personal data is processed when applying for a viewing appointment as well as in the further application process and during an existing tenancy.
As a landlord, property manager or broker, you are a controller within the meaning of the General Data Protection Regulation (GDPR) and obligated in accordance with Art. 13 GDPR to inform interested parties, applicants and tenants about the processing of their personal data. Immodio is not responsible for this and acts solely as the processor.
Privacy Policy
Immodio supports you in fulfilling your information obligations and provides you with a standardised "Data Protection Instruction for Tenants and Prospective Tenants", which includes the following content in particular:
which personal data of prospective tenants and tenants are processed,
for what purposes the data processing is carried out,
which data is typically collected during the application process and during a tenancy,
what rights prospective tenants and tenants have under the General Data Protection Regulation (GDPR).
You can read the content of the (non-personalized) privacy policy here. As an Immodio user, please check whether the processing purposes described in the privacy policy correspond to your actual use and processing of personal data. The tenant will only receive a personalized version of the "Privacy Policy for Tenants and Prospective Tenants" upon conclusion of the rental agreement, which will be transferred to the tenant portal.
If you have your own (personalized) privacy policy/Datenschutzbelehrung or process personal data beyond the purposes described in the Immodio Privacy Policy, for example for additional services, external systems or your own processes, you are obliged to inform the tenant or prospective tenant separately and transparently. In this case, make sure that you have your own privacy policy/Datenschutzbelehrung is made available to the tenant in good time.
1. Privacy when registering on Immodio

When registering on Immodio, the tenant or prospective tenant must agree to the following declarations:
the Immodio Privacy Policy (data protection between Immodio and the tenant), and
the Privacy Policy for Tenants and Prospective Tenants (Privacy Policy between You and the Tenant)
This consent is given before registering on Immodio and is a prerequisite for applying for viewing appointments or using the tenant portal.
2. Data protection when concluding a tenancy

When digitally signing a rental agreement from Immodio, the tenant automatically receives a personalized version of the privacy policy in the tenant portal.
This includes, among other things:
Your information as a data protection controller,
your contact details (e.g. name, address, e-mail),
Information on the processing of data in the existing tenancy.
This ensures that the tenant receives the legally required information in accordance with Art. 13 GDPR.
Yours, Tenant does not have access to the tenant portal?
If your tenant does not have access to the tenant portal, we strongly recommend that you provide the tenant with a personalised privacy policy (on the tenancy) in another way, for example:
as PDF by e-mail or
printed in paper form
Access to the tenant portal can be granted to the tenant at any time by an invitation to the Tenant portal under "Participants" by clicking on "Actions" for a participant.
Please note: The data protection texts and processes provided by Immodio represent standard solutions and suggestions and do not replace individual legal advice. You remain responsible for the proper processing of personal data and for correctly informing your prospective tenants, tenants and other data subjects.
Data Processing Agreement (DPA) with Immodio
By registering with Immodio, you conclude a Data Processing Agreement (DPA) with Immodio. This is required in accordance with Art. 28 GDPR if personal data is processed by a service provider on behalf of a service provider. By concluding the DPA, you instruct Immodio to process personal data of tenants, prospective tenants and applicants exclusively on your behalf and in accordance with your instructions.
Immodio acts as a processor, while you continue to be the data controller. According to Art. 4 No. 8 GDPR, a processor is a body that processes personal data on behalf of the controller. You can find the corresponding AVV as follows:
Open menu
Click on "Show Menu" in the top right corner to open the menu.

Open Settings
Navigate to the Settings section to open your account's settings.

View the Data Processing Agreement (DPA)
Navigate to the "Account" tab. Here you can view and download your DPA with Immodio in the "Order Processing Agreement (DPA)" section.
If you need a copy of the DPA on which your specific customer data is stored, please contact Immodio customer service by e-mail at "service@immodio.app". Our staff will provide you with a copy of the AVV with your specific customer data in a timely manner.
