# Water and waste water

### Usual entries for this part of the statement

In this area you will find typical types of cost that are frequently recorded as part of the statement for **water and waste water**. The overview serves as guidance and helps you choose the appropriate entry categories for your receipts, charge notices or statements.

The list is not exhaustive. Depending on the property, the supplier, the municipality or the contractual arrangement, further cost items can arise or individual items can be named differently. What always matters is which costs were actually incurred, whether they are recoverable and which category they belong to in substance.

Use this category for costs incurred in connection with the **property's drainage** which are to be recovered from the tenants.

These include in particular costs for:

* waste water charges
* foul water charges
* precipitation water or rainwater charges
* sewer charges
* charges for house and property drainage
* the running operating costs of a private drainage system, for example a small sewage treatment plant or a collection pit
* the costs of operating a drainage pump or lifting unit
* regular maintenance or cleaning costs, as far as they serve the running operation of the drainage system
* charges for house and property drainage
* the costs of operating a non-public drainage system or drainage pump

#### When to use this category

Choose this category where you have an invoice, a charge notice or a statement for **waste water, drainage, sewers or foul water**.

#### Important

Only enter **running costs** of the drainage here. Repairs, maintenance or refurbishment may **not** be recovered from the tenants. Section 1 (2) BetrKV expressly excludes maintenance and repair costs from operating costs.

Items that do not belong in this category are, for example:

* repairing a waste water pipe
* replacing or renewing a defective drainage pump
* dealing with a burst pipe
* renovating sewer pipes
* one-off connection costs or sewer construction contributions
* other measures to remedy damage

Use this category for costs incurred in connection with **supplying the property with fresh or cold water** which are to be recovered from the tenants.

These include in particular:

* the costs of the actual water consumption
* maintenance costs for water meters
* the water supplier's basic charges
* the costs of supplying fresh water
* the running costs of the building's own water supply system
* the running costs of a water treatment system, for example a filter system or a softening system
* treatment materials, for example filter material or softening agents
* maintenance costs for water flow regulators or water supply systems
* the costs of pressure boosting systems, where these are necessary for the building's water supply

This category belongs to the **water and waste water** area but concerns only the **water supply**. Enter waste water, drainage and precipitation water in the category provided for them, "[All costs for drainage, waste water outflow, waste water and maintenance, **no** repairs](#alle-kosten-fur-entwasserung-abfluss-abwasser-wartung-keine-reparaturen)".

#### Do not enter in this category

Do **not** enter repairs, maintenance or renewals here. The following are not recoverable, for example:

* repairing a water pipe
* dealing with a burst pipe
* replacing defective system parts
* renovating or renewing the water installation
* the initial purchase or installation of new water meters
* water consumption caused by building work or a burst pipe

Maintenance and repair costs are **not** operating costs and may therefore **not** be recovered from the tenants.

Additional costs caused by a burst water pipe are also **not** regarded as ordinary water consumption and are therefore generally **not** recoverable.

#### Special features

Where there are water meters in the property and consumption is recorded per unit, the water costs should be allocated by consumption. Section 556a BGB provides that consumption-based operating costs are to be allocated by a measure that reflects the differing consumption.

Basic charges and other components of the water supply that are independent of consumption may as a rule be allocated together with the consumption costs. The Federal Court of Justice has permitted this in principle for the cold water supply, but points out that this does not apply without limitation, in particular where there is considerable vacancy.

Use this category for costs incurred in connection with **water meters** which are to be recovered from the tenants according to the statement.

These include, for example:

* the rental or leasing of water meters
* the costs of using water meters or of making them available for use
* calibration costs, or the costs of replacement where this takes place instead of a necessary calibration
* running service or maintenance costs for water meters

The costs of water meters are part of the costs of the water supply under Section 2 no. 2 BetrKV.

#### When to use this category

Choose this category where you have an invoice or a statement showing costs for **cold water meters** or general water meters.

This category belongs to the water and waste water area. It is **not** intended for heating meters, hot water meters within the heating and hot water statement or other types of meter.

Use this category for costs arising from draining **rainwater or precipitation water** from the property.

These include, for example, charges for precipitation water, rainwater, surface drainage or draining water from roof surfaces, yards, driveways or other paved areas.

Choose this category where precipitation water is **shown separately** in your charge notice or your statement.

#### Why is precipitation water entered separately?

Precipitation water differs from foul water. Foul water is regularly linked to water consumption. Precipitation water, on the other hand, arises from rainwater draining into the sewer system from built-up or paved areas of the property.

Precipitation water is therefore often charged according to the size of the sealed or connected areas and **not** according to the individual water consumption of the tenants. Entering it separately ensures that these costs are taken into account correctly and comprehensibly in the operating cost statement.

### Water and waste water in a WEG (owners' association)

Use this category where the unit let is part of an **owners' association (WEG)** and you already have a finished **WEG annual statement** or service charge statement.

Enter here the costs for **water and drainage** shown in the WEG statement for the unit let which are to be recovered from the tenant as part of the operating cost statement.

These can include, for example:

* fresh water / cold water
* foul water / waste water
* drainage
* sewer charges
* precipitation water, where it is shown in the WEG statement together with water and drainage

Choose this category where you do **not** record **your own invoices from the water supplier or the municipality** for the entire property, but where the costs have already been allocated to your unit through the WEG statement.

That is typically the case where you let a single freehold apartment and the WEG's property management has already allocated the water and drainage costs to the individual owners in the annual statement.

#### Assignment

For the assignment select **"Unit"** and then the unit let concerned. The entry is thereby assigned directly to that unit and then taken into account in the operating cost statement for the associated tenancy.
