# Bank account, account management fees

Help on the Immodio entry item Bank account, account management fees.

Use this category for **bank and account management fees arising from your letting activity**.

A typical case of application is a separate rent account through which, for example, rents are received and running expenditure for your let properties is paid.

### What can be entered here?

The running fees of a bank account in particular can be recorded here, **as far as the account is used for your letting**.

This can include, for example:

* monthly or annual account management fees,
* fees for individual transfers,
* fees for entry items,
* the costs of bank statements,
* fees for payment transactions,
* other bank fees directly connected with the bank account relating to the letting.

Deducting them as income-related expenditure requires the costs to be economically connected with your income from letting and leasing.

Section 9 EStG defines income-related expenditure as expenditure to acquire, secure and maintain income. The expenditure is to be deducted from the type of income in respect of which it arose.

### Example: a separate rent account

You keep a separate bank account for your let apartments.

Only the following are received into this account:

* base rents,
* advance payments of operating costs,
* additional payments from your tenants.

From this account you pay, for example:

* tradesmen,
* insurance,
* property tax,
* operating costs,
* property management invoices.

The bank charges **€10 of account management fees per month** for this account. That gives per year: **€10 × 12 months = €120 of account management fees.** These €120 can in principle be taken into account as income-related expenditure in connection with the letting.

### A separate rent account

A separate account exclusively for the letting is particularly clear for documentation for tax.

Where only payments relating to the letting run through the account, the connection between the account management fees and the letting can usually be traced clearly.

### An account used privately and for the letting

Particular care is needed where you also use your ordinary private account for your letting.

The following are received into the same account, for example:

* wages,
* private payments,
* rental income.

At the same time both private expenses and the costs of your let property are paid from this account.

In this case the whole of the account management fees is not automatically income-related expenditure of the letting.

Only the share occasioned by generating income is deductible. For accounts used for mixed purposes, the tax authorities point out in the field of income-related expenditure that flat rate account management fees may have to be split according to the private and income-related account movements.

### Do not confuse with overdraft interest

Interest arising because your account is overdrawn is **not** an ordinary account management fee. Do not enter **overdraft interest or other current account interest in this category**, therefore.

### Loan costs and debt interest do not belong here

Costs directly connected with financing a property should not be recorded as ordinary account management fees.

These include in particular:

* loan interest,
* overdraft interest,
* credit commissions,
* certain costs of obtaining finance,
* fees arising directly for taking out or making available a loan.

### Not recoverable from the tenants

With an ordinary residential operating cost statement, the landlord's account management fees may **not be allocated to the tenants as operating costs**.

The Operating Costs Ordinance expressly excludes administrative costs from operating costs. These include the costs of the facilities and activities necessary for administering the building.

The **"Recoverable in the operating cost statement"** switch should therefore stay disabled for this category.

### Do not enter here

This category should in particular not be used for:

* private account management fees with no connection to the letting,
* overdraft interest,
* loan interest,
* repayments,
* credit commissions,
* the costs of obtaining finance,
* custody fees,
* tax advice costs,
* bookkeeping costs,
* the costs of a property management,
* other expenditure for which Immodio offers a more specific category.

### Which documents should you keep?

Keep in particular:

* the account opening documents or the account agreement,
* the bank's list of prices and services,
* monthly or annual fee statements,
* bank statements,
* evidence of the fees actually being paid,
* with accounts used for mixed purposes, the calculation of the share relating to the letting.

With an account used exclusively for letting purposes, it should also be comprehensible that only payment transactions relating to the letting are actually processed through this account.

## Legally important

Deductible as income-related expenditure as far as there is an objective connection with let properties, see [Sections 9 and 21 EStG](https://www.gesetze-im-internet.de/estg/__9.html). With transactions subject to VAT, the invoice and input VAT are to be checked under [Sections 14 and 15 of the German VAT Act](https://www.gesetze-im-internet.de/ustg_1980/__14.html).
