# Annual financial statements and tax return

Use this category for **the costs of a tax adviser or a comparable professional service, as far as they serve directly to determine and close your income from letting and leasing**.

This can include in particular the costs of the annual preparation of your letting for tax, for example:

* determining the income and income-related expenditure from the letting,
* preparing a statement of surplus for a rental property,
* closing work on the letting accounts,
* checking and reconciling the letting entries recorded during the year,
* determining the depreciation and other values relevant for tax relating to the letting,
* closing work for tax in connection with the letting,
* certain work to produce a separate and uniform determination for asset-managing partnerships,
* other closing work relating directly to the income.

#### Not every tax adviser's invoice is fully deductible

This point is particularly important with this category.

Tax advice costs are only income-related expenditure **if and as far as they arise in determining the income**.

These include, among other things:

* bookkeeping work,
* monitoring the bookkeeping,
* determining income and expenditure,
* summaries,
* preparing balance sheets or statements of income and expenditure,
* the tax advice connected with it.

For you as a landlord this means that the part of the tax adviser's invoice actually arising for **determining the letting income** can in principle be claimed as income-related expenditure.

#### The general income tax return, by contrast, is private

The costs arising merely to carry the results already determined into the private income tax return, or to complete the rest of the income tax return, are in principle not deductible.

The costs of the following in particular:

* completing the income tax return in general,
* questions of tariff and assessment,
* special expenses,
* extraordinary burdens

are attributed to **private living**.

#### Example: a tax adviser's invoice with separate items

The tax adviser charges:

1. **determining the income from letting and leasing: €400**
2. **preparing the income tax return in general: €500**
3. **determining special expenses: €100**

The total invoice: **€1,000**

In principle only the **€400** is then clearly attributable to the letting. The remaining **€600** concerns the private income tax return and is in principle not deductible as income-related expenditure of the letting.

Costs in connection with buying a property can have to be treated differently

Not every tax adviser's service around a property is immediately deductible closing or advice costs.

Advisory services directly connected with:

* acquiring land,
* erecting a building or
* certain modernisation measures

are generally to be attributed to the **acquisition or production costs**.

#### Not recoverable from the tenant

Tax advice and closing costs are the owner's costs.

They are not part of the rental property's running operating costs and may not be recovered from the tenant.

#### Assignment

The annual closing and tax advice costs frequently concern an owner's general letting activity for tax. Select **Assignment → Owner**, therefore.

#### Do not enter here

Do not use this category in particular for:

* the full costs of your private income tax return,
* advice on special expenses,
* advice on extraordinary burdens,
* general advice on tariff or assessment,
* advice on inheritance or gift tax,
* separate legal and tax advice, where the advice category fits better,
* advice costs attributable directly to acquiring the property that are acquisition costs,
* private tax advice with no connection to the letting.

#### Which documents should you keep?

Keep in particular:

* the tax adviser's invoice,
* proof of payment,
* the description of the services on the invoice,
* a breakdown of the fees by type of income, where applicable,
* the assignment to individual rental properties,
* the tax adviser's statement of which share is attributable to the letting, where applicable.
