# Guarantors

This page explains when a guarantor makes sense in a tenancy and how you represent a guarantee in Immodio.

In practice, particularly when letting to students or trainees with little or no income of their own, landlords often try to protect themselves with additional security. A common method is to involve the parents as guarantors in the tenancy.

As a matter of principle, however, a landlord may **not obtain unreasonable security** in a residential tenancy. Under Section 551 (1) BGB, the security may amount to **no more than three months' net base rent**. This rule applies not only to deposits but also to guarantees, where these are required by the landlord.

#### **Immodio offers you two ways to involve a guarantor in the tenancy:**

1. **A voluntary written declaration of guarantee** by the guarantor\
   (you can find a suitable template under [**Templates**](/en/anleitung/vorlagen.md)**.** This declaration of guarantee has to be filled in by the guarantor and signed by hand, as it must be in written form.)\
   → This form of guarantee serves to secure the deposit and is limited to a maximum of three months' net base rent.
2. **Inclusion as a co-tenant in the rental agreement**\
   → Create the guarantor in Immodio under "Parties" as a tenant and then select them as a tenant when creating the contract. **Although this approach is common in practice, it can be legally challengeable in individual cases**: if a person is listed only formally as a co-tenant, without any actual intention of using the apartment, this could be regarded as circumventing the rules on guarantees.
