# Additional people moving in

This page explains what "additional people moving in" means and which legal guideline figures you have to observe in order to avoid overcrowding the apartment.

## Additional people moving in

Additional people moving in are all those who move into the unit **in addition to the tenant** but are not intended to be parties to the rental agreement (for example the tenant's minor children).

If the rental agreement is created from a viewing, the details of additional people moving in are adopted from the application automatically.

Please still check whether **all additional people moving in have been recorded correctly by your new tenant**, as applicants sometimes do not distinguish between additional people moving in and parties to the rental agreement.

#### Overcrowding in an apartment

It is the landlord's responsibility to check the occupancy of the apartment in order to rule out overcrowding. Case law generally assumes that **about 8 to 10 m² of living space per person** should be available. Lower figures are usually assumed for children under 6, often with a guideline of **6 m² of living space**.

Overcrowding usually exists where these figures are not met. What is decisive, however, are always the specific provisions of the applicable housing supervision act, which differ from federal state to federal state. You can find more information about this under **Overcrowding**.

Using the apartment size you have stored and the total number of people moving in, Immodio automatically calculates whether overcrowding might exist and points this out in the rental agreement assistant. The final assessment of overcrowding remains the landlord's responsibility, however.
