# Utility contracts

This page explains the utility contracts in the Immodio rental agreement assistant.

As a landlord it is important to define in the rental agreement which energy costs are billed through the operating costs and which contracts the tenant has to conclude with the utility providers themselves.

### Electricity consumption for the unit

**Select this option (checkbox):**

* If the tenant organises the electricity supply themselves and settles directly with the electricity provider (this is the normal case).

In most cases the tenant concludes their own contract with an electricity provider of their choice. Electricity consumption is settled directly between the tenant and the provider and is then not part of the recoverable service charges.

If you as the landlord conclude the contract with the electricity provider and then bill the tenant, or if you offer an all-inclusive rent, remove the tick from Electricity supply.

### **Hot water preparation**

Whether the tenant or the landlord is responsible for the utility contract for the hot water supply depends on how the hot water is produced. With central hot water preparation, billing is usually handled by you as the landlord or, in the case of an owner-occupied apartment, by the WEG management. The Hot water preparation option then does **not** have to be selected.

**Only select this option (checkbox) if:**

* The apartment or house is used exclusively by the tenant (for example a detached house).
* Hot water is produced locally within the apartment (for example a gas boiler with its own meter).
* Hot water is produced through district heating **and** the district heating provider concludes the contract directly with the tenant.
* Hot water is provided by a contracting provider **and** the tenant concludes the contract directly with them.

With electrically operated water heaters (for example electric boilers or instantaneous water heaters), billing takes place automatically through the tenant's **electricity bill**.

### **Heating**

An apartment is often heated by a central heating system. In that case the landlord concludes the contract with the energy provider and passes the heating costs incurred on to the tenants as part of the operating costs.

**Only select this option (checkbox) if:**

* The residential unit is used exclusively by the tenant (for example a detached house).
* Heating is produced locally in the apartment (for example a gas boiler with its own meter).
* Heat is supplied through district heating **and** the district heating provider concludes the contract directly with the tenant.
* Heat is provided by a contracting provider **and** the tenant concludes the contract directly with them.

### Internet connection

As a rule the tenant arranges their own internet connection with an internet provider. With special forms of letting such as a shared apartment letting, a sublease or partial subletting, however, it can make sense for you as the landlord to provide the internet connection. In that case the Immodio rental agreement automatically contains an additional passage governing the use of the internet connection and liability for possible unlawful activities (for example copyright infringements).

**Select this option (checkbox) if:**

* The tenant organises the internet connection themselves and concludes a contract directly with the provider (the normal case).

If you provide the internet connection, deselect the option.
