# Energy certificate

This page tells you more about the statutory obligation to present an energy certificate when letting, and about the differences between demand-based and consumption-based certificates.

Under **Section 80 of the German Buildings Energy Act (GEG)**, landlords are obliged to present or display a valid **energy certificate** **at the viewing of the apartment at the latest**. This can be either a **demand-based** or a **consumption-based** certificate.

This obligation applies in principle to all buildings that are heated or cooled.

**There is no certificate obligation, for example, for:**

* unheated storage or garage space
* buildings with a usable area of less than 50 m²
* listed buildings
* holiday properties used for less than 4 months a year
* buildings due for demolition

**The following details are also required in the letting advertisement:**

* the type of energy certificate (demand-based or consumption-based)
* the final energy demand or consumption value according to the energy certificate
* the main energy sources for heating the building named in the energy certificate
* the year of construction of the building according to the energy certificate
* the energy efficiency class according to the energy certificate

**Caution:** As a rule, creating a consumption-based certificate is sufficient. In some cases, however, you are obliged to create a demand-based certificate ("[Obligation to issue a demand-based certificate](#pflicht-ausstellung-eines-bedarfsausweis)"). A missing or incorrect energy certificate can be treated as an administrative offence and punished with a fine. <summary><strong>Demand-based certificate</strong></summary>

The demand-based certificate is based on a technical analysis of the building. It assesses energy demand using factors such as insulation, window quality, the heating system and the construction method, independently of actual user behaviour.

**Advantages:**

* Independent of user behaviour (as it is not based on consumption data)
* Shows specific refurbishment recommendations

**Disadvantages:**

* Considerably more expensive than a consumption-based certificate
* More time-consuming to produce

**Advantages:**

* An objective assessment of the building's energy quality
* Independent of user behaviour
* Meaningful for vacant properties or new builds
* A basis for refurbishment recommendations

**Disadvantages:**

* More expensive than a consumption-based certificate
* Requires precise building and construction documents

<summary><strong>Obligation to issue a demand-based certificate</strong></summary>

In principle landlords (owners) can choose whether to have a demand-based or a consumption-based certificate created for their property. Because of the lower cost, creating a consumption-based certificate is generally more in the landlord's interest. In the following cases, however, the demand-based certificate is mandatory:

* For new builds, since no consumption data for the last three years is available. (The same applies after certain modernisation measures have been carried out on the building for which an energy certificate has to be issued under Section 80 (2) GEG.)
* For buildings with fewer than 5 residential units whose planning application was submitted before 1 November 1977 (before the 1977 Thermal Insulation Ordinance came into force) and which have not been refurbished in accordance with the Thermal Insulation Ordinance.
