# House rules

### General information on house rules

House rules serve to ensure orderly, undisturbed cohabitation in the building. They give concrete form to the obligations the tenant has already assumed in the rental agreement, in particular regarding the use of the rented property and behaviour in the shared living environment. As a rule the house rules become part of the rental agreement as an annex. **Only then are they legally binding.** If they are merely displayed in the hallway, they have **no contractual effect**. That is only the case if they are **part of the rental agreement**. **Immodio therefore always advises attaching house rules to the rental agreement.**

#### House rules already exist

If house rules already exist for your building, Immodio recommends continuing to use them. New house rules or changes to the existing version may require **the consent of all existing tenants affected**. This field is filled in by default if house rules have already been stored as a PDF file in the [property](/en/anleitung/immobilien/objekt.md) in the House rules tab.

#### No house rules exist

If no valid house rules exist for your property, which is often the case for **new builds or first lettings after refurbishment**, Immodio offers you the service of creating individual house rules. This field is hidden by default if house rules have already been stored as a PDF file in the [property](/en/anleitung/immobilien/objekt.md) in the House rules tab.

#### House rules for a WEG unit

**Particularity for condominium owners' associations (WEG):** In these cases valid house rules usually already exist. They are part of the **declaration of division or the community rules** and have to be applied accordingly. If you are unsure, please contact your **WEG management**. Upload these in the [property](/en/anleitung/immobilien/objekt.md) in the House rules tab as a PDF file as well, so that they are sent to your tenant automatically.

Immodio offers you the service of having house rules created individually for your property. Individual provisions can be included on the following topics:

* **Barbecuing with charcoal** is permitted
* **Barbecuing with gas** is permitted
* An **underground garage** exists and is let with the property

The house rules are then generated by Immodio, sent to your tenant together with the other generated documents and stored directly in the property. This means they can be assigned to all future tenancies.

<summary><strong>Existing house rules</strong></summary>

You can upload existing house rules as a PDF file. Once uploaded, the house rules are stored automatically in the master data of the property concerned.

As soon as the house rules are saved there, they are adopted automatically when future tenancies are created and shown in the rental agreement.

<summary><strong>Do not add house rules</strong></summary>

As a rule the house rules are attached to the rental agreement as an annex. Only then are they fully legally binding on the tenant. If the house rules are merely displayed in the stairwell, they have **no contractual effect**. In that case only rules of order (for example provisions on use or on quiet hours) take legal effect, but no further obligations for the tenant. **Immodio therefore recommends always attaching the house rules to the rental agreement** in order to create a clear contractual basis.

Most properties already have valid house rules. If your unit is part of a condominium owners' association (WEG), the currently valid house rules of the WEG have to be used. If you have questions or are unsure, you should contact your property management company.

### Further information on house rules

<summary><strong>Breach of the house rules</strong></summary>

If a tenant breaches the valid house rules, the landlord can insist on compliance. In the case of repeated or serious breaches of duty, this can even justify terminating the tenancy. You can find suitable templates on warnings and termination in Immodio under "Templates".

<summary><strong>Changing the house rules</strong></summary>

The landlord cannot change the house rules unilaterally. Such changes are only effective if they are agreed contractually with the tenant, for example by signature or by integration into the rental agreement.
