# Unit details

This page explains when a unit counts as renovated and how decorative repairs can be validly transferred to the tenant.

## Condition of the unit

For **renovated** units, the tenant can be obliged to carry out decorative repairs under certain conditions.\
\
For **unrenovated** units, the landlord may release themselves from their own obligation to carry out these repairs, but they **cannot readily** transfer them to the tenant.<br>

* An apartment counts as **renovated** if it makes a well-kept and tidy impression **overall**. Slight signs of use are disregarded, provided the overall impression appears renovated from the point of view of an objective observer.

If you are unsure about the condition of the unit, choose the option **"unrenovated"**. In that case the tenant **cannot be obliged to carry out decorative repairs**, but as the landlord you are then also not obliged to bear them in the event of a dispute.

<summary><strong>What decorative repairs are</strong></summary>

Decorative repairs are **repair works** to restore the outward appearance of the rented rooms. They include, among other things:

* painting or whitewashing walls and ceilings
* wallpapering
* filling dowel holes
* painting floors
* painting or varnishing radiators, pipes, internal doors, windows and the inside of external doors

The aim is to restore the original visual condition of the rented property.

<summary><strong>Legal background on decorative repairs</strong></summary>

In principle, maintaining the rented property is the landlord's responsibility under Section 535 (1) sentence 2 BGB. In a rental agreement, however, decorative repairs can be validly transferred to the tenant under certain conditions.

* For renovated units, the tenant can be obliged to carry out decorative repairs to a certain extent and under certain conditions.
* For unrenovated units, the landlord can only release themselves from the obligation to carry out the decorative repairs, but cannot necessarily transfer them to the tenant. The condition is that the landlord has worded the relevant clause in the rental agreement in a legally sound way. If such a clause is missing from a rental agreement, the landlord has to have the work carried out at their own expense or reimburse the tenant for the cost of the decorative repairs.
