# Signing the rental agreement

This page explains how you and your tenant can sign the rental agreement in Immodio.

Once the rental agreement has been paid for, Immodio automatically creates the new tenancy and generates a contract preview. From this point the rental agreement is ready for the tenant to sign digitally.

Please note: before you as the landlord (manager or estate agent) can sign the contract, **the tenant has to have signed first.** This guarantees that a valid rental agreement between all contracting parties is only ever concluded once you as the landlord have added your final signature.

How your tenant signs depends on **whether or not they have access to the Immodio tenant portal**.

Even if the draft rental agreement has already been transferred to your tenant's tenant portal, the tenant can still sign on site through the landlord version of Immodio on your device, if you prefer.

## 1. The tenant's signature

### Option A: your tenant signs in the tenant portal

Once you have paid for the tenancy, Immodio automatically checks whether your new tenant already has access to the tenant portal. If access exists, this is shown to you in the middle card and all documents are transferred to the tenant automatically.

Access to the tenant portal always exists where you selected the new tenant through the digital Immodio viewing management or [invited them to the tenant portal](/en/wissen/mieterportal/einladung-in-das-mieterportal.md) manually under [Parties](/en/anleitung/beteiligte.md).

If no access exists yet, the "Invite tenant" button lets you generate a link the tenant can use to register in the tenant portal. All documents are then made available to them there digitally and they can sign the rental agreement digitally on their smartphone or computer.

* The tenant automatically receives a **notification once you have created the draft rental agreement** and it is available to them in the tenant portal.
* When your new tenant logs in to the tenant portal, they can see your new tenancy under "**Tenancies**". Clicking the tenancy lets them view all documents and download them if needed.
* The signature is made digitally in the tenant portal by clicking "**Sign**" in the tenancy.
* As soon as all tenants have signed the contract, you receive a notification in Immodio. You can now countersign the contract.

Tenants gain access to the tenant portal if they registered with Immodio when requesting a viewing appointment as part of a viewing. ### Option B: your tenant signs on site on your device

* Alternatively your new tenant can also sign digitally on your own device. The signature is then made, for example, **at a personal appointment** or **during the apartment handover**.
* Open the tenancy in your Immodio account; the tenant can sign the contract digitally directly on your device.
* As soon as **all tenants** have signed, the contract is automatically released for you to countersign.

## 2. The landlord's signature

Once your tenant has signed, you can countersign the rental agreement.

1. Open the relevant **tenancy** and go to the **"Documents"** area.
2. The **"Show draft"** button lets you **review the rental agreement in full once more** before signing.
3. Then click **"Sign"**.\
   Tick the boxes to confirm that all the details are correct; you can now add your digital signature in the **signature field**.
4. Once saved, the rental agreement is fully **signed by both parties** and is stored automatically in the tenancy.

<summary><strong>Signing as an estate agent or manager</strong></summary>

If you use **Immodio as an estate agent or property manager** to let units, you act **on behalf of the landlord (the property owner)** named as a **contracting party** in the rental agreement.

If you sign the rental agreement **in the landlord's name**, Immodio recommends adding a note to the signature **such as "i. A." (on behalf of)**.

Please note that **appropriate authority** from the property owner is required in order to conclude contracts in their name with legal effect.
