# Sublease agreement

Creating sublease agreements is not yet available in Immodio.

<mark style="color:$info;">A sublease exists where a tenant or the tenant's representative sublets a unit (apartment) in whole or in part to a third party (the subtenant). The tenant remains the landlord's official contracting party and continues to bear all obligations under the rental agreement concluded, for example the obligation to pay rent and responsibility for any damage. These obligations also apply to damage caused to the rented property by a subtenant.</mark>

<mark style="color:$info;">In principle tenants may sublet their apartment, but in most cases they need the</mark> <mark style="color:$info;">**landlord's permission**</mark> <mark style="color:$info;">(Sections 540, 553 BGB). This is also what the Immodio rental agreement provides.</mark>

<mark style="color:$info;">A unit can be sublet permanently or temporarily and in whole or in part.</mark>

<mark style="color:$info;">Tenants can sublet a unit either</mark> <mark style="color:$info;">**in whole**</mark> <mark style="color:$info;">or</mark> <mark style="color:$info;">**in part**</mark><mark style="color:$info;">:</mark>

<mark style="color:$info;">**The whole unit:**</mark> <mark style="color:$info;">If the entire unit (apartment) is sublet and the tenant no longer lives there themselves, they always need the</mark> <mark style="color:$info;">**landlord's consent**</mark><mark style="color:$info;">. If a tenant sublets an apartment without the necessary permission, they breach their contractual obligations and risk the landlord being able to terminate the tenancy. Under Section 573 (2) no. 1 BGB, unauthorised subletting can constitute an important reason for termination by the landlord.</mark>

<mark style="color:$info;">**Partial subletting of the unit:**</mark> <mark style="color:$info;">If a tenant continues to live in the unit and sublets only one or more rooms, the landlord</mark> <mark style="color:$info;">**cannot readily refuse**</mark> <mark style="color:$info;">permission under Section 553 (1) sentence 1 BGB, provided there is a legitimate interest (for example financial or personal reasons).</mark>

* <mark style="color:$info;">**Permanent:**</mark> <mark style="color:$info;">The tenant provides the unit or parts of it to a subtenant for a longer period or indefinitely.</mark>
* <mark style="color:$info;">**Temporary:**</mark> <mark style="color:$info;">The tenant lets the unit or parts of it only temporarily, for example for a few months during a stay abroad.</mark>

<summary><mark style="color:$info;"><strong>Subletting to tourists</strong></mark></summary>

<mark style="color:$info;">Important: The</mark> <mark style="color:$info;">**unauthorised provision of the apartment to third parties**</mark> <mark style="color:$info;">can be an important reason for</mark> <mark style="color:$info;">**termination without notice by the landlord**</mark> <mark style="color:$info;">**(Section 543 (2) no. 2 BGB).**</mark>

<mark style="color:$info;">**Letting to tourists as a holiday apartment**</mark> <mark style="color:$info;">in particular does not count as ordinary subletting and is impermissible even where the tenant has general permission to sublet.</mark>

<mark style="color:$info;">The</mark> <mark style="color:$info;">**Federal Court of Justice (BGH)**</mark> <mark style="color:$info;">has ruled that</mark> <mark style="color:$info;">**letting to tourists**</mark> <mark style="color:$info;">differs substantially from long-term subletting and that</mark> <mark style="color:$info;">**separate consent from the landlord**</mark> <mark style="color:$info;">is therefore required.</mark>

<mark style="color:$info;">To avoid legal consequences, a tenant should obtain the landlord's express consent before any intended subletting to tourists.</mark>
