# Payment details

This page provides guidance on when the rent is due, possible late payment fees and stating the bank details.

The tenant is obliged to pay the agreed rent on time in return for the use of the apartment. Where the rental agreement so provides, advance payments for operating costs or a flat rate for operating costs also have to be paid together with the monthly rent.

### When the rent is due

Under Section 556b BGB, the rent is payable **monthly in advance**, by the **third working day of a month** at the latest. What matters is when the payment arrives in the landlord's account.

In the Immodio rental agreement generator you can also define individually when the rent is due, for example on the first working day of a month or at a later date. The arrangement agreed is adopted in the rental agreement automatically. Once this deadline has passed, the tenant is automatically in default if they have not paid.

### Late payment fees

Immodio proposes **a flat-rate late payment fee of €2.50 by default**. It applies when the tenant is in default with the rent payment. You can adjust this value individually in the *"Late payment fees"* field or **charge no late payment fees at all**.

The guideline figure of €2.50 is based on an older judgment of the **Local Court of Brandenburg an der Havel (judgment of 25/01/2007 – 31 C 190/06)**. At the time the court considered this amount **just about reasonable**, since only minor actual costs arise when a reminder letter is generated automatically. This case law is not from the highest court, however. In individual cases it can also be argued that inflation-related cost increases may be taken into account when assessing reasonableness.

What is decisive, however, is that **late payment fees may only ever cover the costs actually incurred**. **Immodio recommends not exceeding** the proposed amount of **€2.50** unless demonstrably higher expenditure can be evidenced.

A flat-rate agreement on late payment fees is **only permissible** if it is not unreasonably high **and** the tenant has the opportunity to prove that the loss was lower. The Immodio rental agreement therefore automatically contains the legally required note under Section 309 no. 5 BGB that the tenant may expressly prove that the flat-rate late payment fees are unreasonable.

### Bank details

* Immodio adopts the bank details automatically from the owner's master data stored under Parties. You can adjust the details individually at any time if needed.
