# Term

In this step you select the start of the tenancy and optionally set a minimum rental period or a fixed term.

The **start of the tenancy** is the date on which the tenancy begins. From that day the tenant may use the unit and is obliged to pay rent. All contractual obligations also apply from this point.

The following arrangements can be made regarding the rental period. They are, however, **strictly regulated by law:**

1. [**Minimum rental period:**](/en/anleitung/mietverhaltnisse/mietverhaltnis-anlegen/zeitraum/mindestmietdauer.md)\
   The rental agreement runs indefinitely but can be terminated **at the earliest once an agreed minimum rental period has expired**. After that the normal statutory notice periods apply (Section 573c BGB).
2. [**Fixed term:**](/en/anleitung/mietverhaltnisse/mietverhaltnis-anlegen/zeitraum/befristung.md)\
   The rental agreement is limited to a specific period from the outset (Section 575 BGB). A fixed term generally has to be justified in the rental agreement (for example personal use). Without a legally recognised reason for the fixed term, it is **invalid** and the contract counts as open-ended.
