# Additional agreements

This page explains which "other agreements" can be included in the rental agreement and how you should word individual agreements.

In the Immodio rental agreement generator you can include additional agreements in the rental agreement. You can either insert pre-worded, legally reviewed **"other agreements"** by ticking a box, or word **"individual agreements"** freely.

### Other agreements

By ticking a box you can include other agreements reviewed by lawyers in the rental agreement. The following other agreements are currently available:

<summary><strong>1) Ban on drilling into tiles</strong></summary>

This clause prohibits the tenant from drilling into tiles and grouting, for example to fit towel rails or mirror cabinets. For the ban to be effective, the bathroom should already be equipped with all the necessary fittings. If such basic fittings are missing, the tenant cannot readily be prohibited from fitting them. Immodio recommends providing the following items:

* a towel rail at the washbasin (and at the shower or bath)
* a toilet roll holder
* a mirror cabinet or a mirror with a shelf and light
* if there is no splash guard: a shower curtain rail

**Important:** Document these fittings as items in the unit in Immodio. They are then also adopted in the handover report. Only in this way can you claim compensation from the tenant for damage to tiles.

<summary><strong>2) The new tenant takes over items from the previous tenant</strong></summary>

Choose this additional agreement if the new tenant takes over furnishings or structural changes from the previous tenant (for example floor coverings, wallpaper, furniture or a kitchen). This makes clear that they are not part of the rented property and that the landlord therefore has no obligation to maintain or repair them.\
\
This additional agreement also ensures that the tenant is obliged to remove the items taken over in full when they move out.

**Important:** So that the takeover of the items can be proven later, they have to be recorded in the handover report.

<summary><strong>3) Loan of a fitted kitchen</strong></summary>

If you select this clause, it is agreed with the tenant that the fitted kitchen is provided as a loan under Section 598 BGB. This means the kitchen is made available for use free of charge and outside the actual rented property. In this case the landlord is not obliged to maintain the kitchen or provide a replacement if it breaks.

* However, it is **not conclusively settled in law** whether this arrangement is effective in every individual case, particularly where the kitchen constitutes a significant part of the apartment or was advertised as an essential feature when the contract was concluded.

No rent surcharge may be charged for the kitchen in this case, since a loan is **always free of charge**. Make sure that the **agreed rent would also be in line with the market without a kitchen**. If you calculate the rent on the basis of a rent index, you may not include a surcharge for a fitted kitchen here.

### Individual agreements

In the Immodio rental agreement generator you can include agreements negotiated individually with the tenant in the rental agreement. You can word these agreements freely in order to address specific needs or particular circumstances.

It is important that these individual agreements do not conflict with the standard clauses of the Immodio rental agreement and do not breach any statutory provisions.

In individual cases we recommend having such agreements reviewed by a lawyer in order to avoid legal uncertainty and ensure the validity of the rental agreement and of the individual agreements.
