It serves as security for possible claims arising from the tenancy, for example rent arrears, damage to the apartment or outstanding operating costs. The rental deposit may not be kept in the landlord's private account. The law requires the deposit to be held with a credit institution separately from the landlord's own assets. **Legal basis** > **Section 551 (3) BGB** > > "The landlord must invest a sum of money provided as security with a credit institution at the interest rate customary for savings deposits with a three-month notice period. The contracting parties may agree a different form of investment. In both cases the investment must be separate from the landlord's assets and the returns accrue to the tenant." The following legal requirements therefore apply to you as a landlord when managing the rental deposit: * The deposit must be **held with a credit institution** and may not be kept in the landlord's private account. * The deposit must be **held separately from the landlord's assets** and is therefore also protected in the event of insolvency. * The deposit must **bear interest at the usual market rates.** The interest increases the deposit and accrues to the tenant. * The landlord must be able to **prove the proper investment of the deposit at any time** and is obliged to provide the tenant with information about how it is held *(Federal Court of Justice, judgment of 13/10/2010 – VIII ZR 98/10)*. This means: * You may require a maximum of **3 months' net base rent** as rental security * Operating costs may **not be included in the calculation** **Paying the deposit in instalments** Tenants may pay the deposit in **three equal monthly instalments**. Legal basis: > **Section 551 (2) BGB**\ > If a sum of money is to be provided as security, the tenant is entitled to pay in three equal monthly instalments. The first instalment is due **at the start of the tenancy**, the other two with the following rent payments. ***
